Terms of Use
Adventure Mutt is a subscription app for children. You buy it, and cancel it, through your Apple Account — we never see a card number.
1. Who we are
Adventure Mutt is made and operated by Symphony Works, LLC ("we", "us", "our"), a Delaware limited liability company. You can reach us at support@adventuremutt.com.
These Terms of Use are an agreement between you and us. They cover the Adventure Mutt app for iPhone and iPad, the website at adventuremutt.com, and the stories we deliver to the app. By downloading the app or subscribing, you accept them. If you do not accept them, do not use the app.
2. What Adventure Mutt is
Adventure Mutt is a bedtime storyteller. Each night the app offers a new illustrated story that a child steers by tapping two or three doors at the foot of each page. Stories run to a fixed ending — typically eight to twelve pages — and finished stories stay on a shelf inside the app to be read again.
Every page a child reads was written and reviewed before it was published. Nothing is composed on the spot while your child is reading, and there is nowhere in the child's part of the app to type anything.
The app downloads stories from us over the internet and then plays them from the device. Once a story is on the device it needs no connection at all.
3. Who may use it
You must be at least 18 years old and legally able to enter a contract to buy a subscription. The app is designed for children, but the customer is the adult who buys it. If you set the app up for a child in your care, you do so as their parent or legal guardian, and you accept these Terms on their behalf as well as your own.
We do not create accounts. During setup a grown-up types in your child's first name, so that the stories can use it — that name is written to your device and never sent to us. Beyond it we ask for nothing else about a child, and a child is never the one typing: there is nowhere in the child's part of the app to enter text at all. 4. The subscription
Adventure Mutt is sold only as a subscription. There is no free version and nothing else to buy inside the app.
The subscription is called Adventure Club. It costs 4.99 US dollars per month, or the equivalent price Apple sets for your country's App Store, and it renews every month until you cancel it. The price you will actually be charged is always the one shown on the purchase screen in the app and on Apple's own confirmation sheet, in your own currency.
If your Apple Account has not used an introductory offer for Adventure Club before, your first three days are free. The free period starts when you subscribe. If you cancel before it ends you are not charged. If you do not cancel, the subscription begins and you are charged the monthly price. Eligibility for the free period is decided by Apple, once per Apple Account, and the app only offers it to an account Apple says is eligible.
Payment is taken by Apple and charged to your Apple Account when you confirm the purchase. Your subscription renews automatically at the end of each monthly period unless you turn off automatic renewal at least 24 hours before that period ends. Apple charges the renewal within the 24 hours before the period ends.
You can view, change or cancel the subscription at any time in Settings on your device, under your Apple Account, then Subscriptions. Cancelling stops the next charge; it does not shorten the month you have already paid for. Deleting the app does not cancel a subscription.
If a free period is running when you subscribe to a paid plan, any unused part of it is forfeited.
If we change the price, Apple will tell you and ask you to agree before the new price is charged. If you do not agree, the subscription ends at the end of the current period.
5. Refunds
Apple handles all billing for the app, so Apple also handles refunds. Requests go to Apple, at reportaproblem.apple.com, under Apple's own policies. We cannot issue a refund for an App Store purchase ourselves. If something has gone wrong, write to us anyway at support@adventuremutt.com — we would rather know.
Nothing here affects any right to cancel or be refunded that your local consumer law gives you and that cannot be waived by agreement.
6. What your subscription gives you
While your subscription is active we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and to read the stories it delivers, for your own household's private and non-commercial enjoyment, on Apple devices you own or control.
The number of stories a household holds is set by the app rather than by this agreement, and it works like this: a set of stories unlocks the night you join, one more unlocks each day after that, and a device stops downloading once it is holding thirty stories nobody has read yet. Reading makes room for more.
If your subscription lapses, stories you have already finished stay on the shelf and remain readable. Stories that were downloaded but never started stop being available until you subscribe again.
7. What belongs to whom
The stories, the artwork, the voice of the app, the characters, the name Adventure Mutt and everything else we made stays ours or our licensors'. Your subscription is permission to read it, not a transfer of it.
The names you type in for your children, the choices your child makes and the books that result from them are yours. They are stored on your device and we do not receive them.
You may export a finished book from the app as a set of images and keep or share it privately — that is what the export is for. You may not sell it, publish it, or present it as your own work.
8. What you may not do
You may not copy, redistribute, sell, sublicense or publicly perform the stories; strip or alter the app's or the stories' identifying marks; reverse-engineer, decompile or tamper with the app or with the signed files it downloads, except to the extent that applicable law says you may do so despite this sentence; use the app or the stories to train a machine-learning model; or use any automated means to download our stories in bulk.
9. Availability, and what we do and do not promise
We intend to publish a new story every day, and the app is built around that rhythm. We do not guarantee a particular number of stories, a particular schedule, or that any specific story stays available for ever. Stories may be corrected, replaced with a revised version, or withdrawn. A story your child has already started or finished never changes underneath them.
The app needs a connection to download stories. It does not need one to read them. We do not promise that the service will be uninterrupted or error-free, and we may change how the app works, add to it, or remove parts of it.
We may suspend or end your access if you break these Terms in a way that is serious or that you do not fix after we ask.
10. No warranty
To the fullest extent permitted by law, the app and the stories are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Some jurisdictions do not allow the exclusion of implied warranties. Where that is the case, the exclusion above does not apply to you, and any implied warranty is limited to the shortest period the law allows.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or connected with your use of the app.
Our total liability to you for any claim connected with the app or these Terms is limited to the greater of the amount you paid us for the subscription in the twelve months before the claim arose, or 50 US dollars.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, you keep every right your local consumer law gives you.
12. Apple
The following applies because you obtained the app through Apple's App Store.
These Terms are between you and us alone, and not with Apple. We, not Apple, are solely responsible for the app and its content.
Your licence to use the app is a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
Apple has no obligation to provide any maintenance or support for the app. We provide support at support@adventuremutt.com.
We are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed above. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
We, not Apple, are solely responsible for the investigation, defence, settlement and discharge of any claim that the app or your use of it infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of them Apple will have the right to enforce them against you as a third-party beneficiary.
13. Changes to these Terms
We may update these Terms. When we do, we will change the version and date at the top and publish the new version at adventuremutt.com/terms. If a change materially reduces your rights, we will give you notice in the app before it takes effect. Continuing to use the app after a change takes effect means you accept it; if you do not, cancel the subscription.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you the protection of your home courts and mandatory local rules, this section does not take that away from you.
